The 2023 Act, which formally repeals the 2005 CCTV provisions, creates a new regime designed to comply with GDPR. Part of this mandatory transition will no longer allow community groups to apply directly for new authorisations; instead, all public CCTV schemes must be authorised by the Garda Commissioner under the new Act, with authorisations granted specifically to Garda personnel or a Local Authority, as a data controller is required.
Community groups can however engage with their local authority to propose a CCTV scheme. The council acts as the data controller, partners with An Garda Síochána, and submits the required application required.
