FOI_In October 2015 An Garda Síochána became subject to Freedom of Information under the Freedom of Information Act 2014 (FOI Act). Under Part 1(n) of Schedule 1 of the FOI Act, a number of agencies were defined as “partially included” and An Garda Síochána is listed as one of them. The Freedom of Information Office is based in Athlumney House, Navan, is headed by a Superintendent and contains a further six staff.

The FOI Act provides access by the public to records held by FOI Bodies while balancing the public interest and the right to privacy of individuals. In order to achieve this, the FOI Act sets out the rights and responsibilities for both the requester and the FOI bodies. In addition, it provides certain exemptions that may be applied to the records subject to an FOI request.

Section 42 of the FOI Act places restrictions on certain records held by An Garda Síochána. Please see the Exemptions section for details.

Part 1(n) of Schedule 1 of the FOI Act states that An Garda Síochána is subject to the Act in relation to “administrative records relating to human resources, finance or procurement matters" only.

The term "administrative records" is understood to mean records relating to the processes of running and managing a business or organisation. As a result the FOI Act excludes operational policing matters such as the prevention and detection of crimes.

Requests from members of the public relating to personal information held by An Garda Síochána should be addressed to the Data Protection Office.

In keeping with FOI Act, An Garda Síochána provides information about the organisation and its activities via the Publication Scheme and also provides access to the decisions made on requests for non personal information through our Decision Log. The website also provides information about the organisation not included by the FOI Act.

If you are considering submitting a request for information it may be useful to review these sections as the information you require may already be available.

When making your request, you should state that you are making your request under the FOI Act. Your request should also be as specific as possible to assist us in identifying the related records and, if possible, indicate a time-frame which applies to your request (e.g. all of 2015, January 2016 to July 2016). The FOI Act only applies to records created by An Garda Síochána from 21st April, 2008. 

Please also indicate whether you seek records for Human Resources, Finance, or Procurement.
