Audit of the exercise by An Garda Síochána

Following recommendations contained in the Ombudsman’s for Children’s Report into the removal of two Roma children from their families by An Garda Síochána, known as the Logan Report, the Garda Commissioner engaged the services Professor Geoffrey Shannon to conduct an independent audit of the exercise by An Garda Síochána of Section 12 of the Child Care Act, 1991.Professor Shannon is a leading authority in Child and Family Law. He is Deputy Director of Education and Senior Lecturer in Child and Family Law at the Law Society of Ireland and has held a variety of roles including Chairman of the Adoption Authority of Ireland. In 2006 he was appointed as the Special Rapporteur on Child Protection and continues in that role to date.

The audit included the following:

• A review of the number of incidents recorded on PULSE since 2008 involving the exercise of section of the Child Care Act 1991 to establish any changes in pattern.

• A more in-depth review of all section 12 events recorded on PULSE in 2014, including:
  •     A review of all Pulse incidents where section 12 powers were exercised.
  •     A questionnaire to be completed by reporting/investigating member in respect of any occasion in 2014 that section 12 powers exercised.
• A review of all files available in respect of any occasion section 12 powers exercised by Gardaí in 2014.

• Interviews with a random sample of Gardaí who exercised section 12 powers in September 2015, to establish whether there has been any change in understanding / practice since the publication of the Logan Report.

• Focus Groups with:
  •     A representative sample of Gardaí who exercised section 12 powers.
  •     A similar sample of Supervisory personnel.
