Section 30 Offences against the State Act 1939 - Update 27th September 2012

The 32 year old man arrested in connection with an investigation in Dublin 2 yesterday has been released without charge this evening (27/9/12)

A file will now be prepared for the information of the Director of Public Prosecutions.


The second man arrested (41 years) remains in Garda custody.

Arrest of two males in Dublin 2 under section 30 OASA 1939 on the 26th Sept 2012

Arrest of two men in Dublin 2 on the 26th Sept 2012 for an offence under section 30 Offences against the State Act 1939 as amended.

Detectives at Harcourt Square, Dublin 2 became aware of suspicious activity in the vicinity of Harcourt Square on 26th September 2012. A person known to them was observed at a nearby hotel. Investigations revealed that this person rented a room overlooking Harcourt Square. This room was booked in a false name.

As a result an investigation was launched involving the Special Detective Unit as a result of which two men (41 & 32yrs) were arrested at Grafton Street on Wednesday evening the 26th Sept 2012. These men are being held under Section 30 of the Offences against the State Act for membership of an unlawful organisation and providing assistance to an unlawful organisation at Irishtown Garda Station.

A search of a hotel room near Harcourt Square resulted in the seizure of equipment which it is believed was being used for surveillance purposes. Investigations are ongoing.
